Introduction

Welcome to Deal Goblins ("Platform," "we," "us," or "our"). By accessing or using our platform, you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, you must not use our services.

Deal Goblins is a platform that connects diners with real food and drink deals from hospitality venues across Australia. We help venues publish genuine offers and help diners discover authentic deals without the noise of regular menu items.

Use of the platform is also governed by our Privacy Policy. By using Deal Goblins, you acknowledge that you have read and understood our Privacy Policy.

Eligibility

Anyone may browse and view deals on Deal Goblins. However, venue owners must be at least 18 years old or have legal parental or guardian consent to create an account and list venues. You are responsible for ensuring your use complies with applicable laws in your jurisdiction.

Venue owners must be authorized to represent the venue they are listing and must have the legal capacity to enter into binding agreements. By creating a venue listing, you represent and warrant that you have the authority to do so.

User Accounts

  • •You must provide accurate and complete information during registration. This includes your full name, email address, and any other required details.
  • •You are responsible for maintaining the confidentiality of your account credentials. You must not share your account with others or allow unauthorized access.
  • •You must notify us immediately if you suspect any unauthorized access to your account or any security breach.
  • •We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activities, or misuse the platform.
  • •Deal Goblins currently uses Google authentication only. By using our platform, you agree to comply with Google's terms of service and privacy policy.
  • •Verification: We reserve the right to verify your identity, email address, phone number, and venue ownership. We may require additional documentation or information to verify your account. We reserve the right to reject or suspend venues pending verification. Failure to provide requested verification information may result in account suspension or termination. Verification does not constitute an endorsement or guarantee of a venue's quality, legitimacy, or compliance with applicable laws or regulations.
  • •User Content Accuracy: You may not submit false, misleading, or fraudulent information to the platform, including incorrect venue edits, reviews, reports, or any other user-generated content. All information you provide must be accurate and truthful.
  • •Rate Limiting and Throttling: We reserve the right to rate-limit, throttle, or restrict access to the platform to prevent abuse, protect against automated systems, bots, or any activity that may harm the platform or its users. We may implement technical measures to detect and prevent abusive usage patterns without prior notice.

Venue Owner Responsibilities

As a venue owner using Deal Goblins, you agree to:

  • •Provide accurate and truthful information about your venue, including name, address, contact details, and business hours.
  • •Only publish genuine deals that are actually available to customers. Deals must represent real discounts, specials, or offers, not regular menu items.
  • •Maintain the accuracy of your deal listings, including pricing, availability, and timing information. Update or remove deals that are no longer valid.
  • •Honor all deals published on the platform. Failure to honor published deals may result in account suspension or termination.
  • •Comply with all applicable laws, regulations, and industry standards, including food safety, licensing, and advertising regulations.
  • •Respect the deal limits associated with your subscription plan. Free plans allow 1 venue with 1 hero deal, Prime plans allow 3 venues with up to 3 hero deals per venue and unlimited regular deals, and Elite plans allow unlimited venues with up to 3 hero deals per venue and unlimited regular deals.
  • •Provide accurate contact information, including a valid email address and phone number. We reserve the right to verify this information and may suspend accounts with unverified or invalid contact details.

Deal Listings and Content

All deal listings must comply with the following requirements:

  • •Accuracy: All pricing, descriptions, and timing information must be accurate and current.
  • •Authenticity: Deals must represent real offers, not regular menu prices or standard offerings.
  • •Completeness: Deal listings must include all relevant information, including regular price, deal price, what's included, and when the deal is available.
  • •Images: Images used in deal listings must accurately represent the offer and must not be misleading or deceptive.
  • •Moderation: All deals are subject to review and moderation. We reserve the right to reject, edit, or remove any deal listing that does not meet our standards or violates these terms.

Deal Goblins reserves the right to verify deal information and may contact venues to confirm deal validity. We may remove deals that are found to be inaccurate, misleading, or in violation of these terms.

Deal Availability: Venues may modify or withdraw deals at any time without notice. Deal Goblins is not responsible for changes made by venues, including deal modifications, withdrawals, or unavailability. Deal availability, pricing, and terms are subject to change by venues at their sole discretion.

Subscription and Billing

Deal Goblins offers three subscription plans:

  • •Free Plan: $0/month - Includes 1 venue listing, 1 hero deal per venue, and basic features.
  • •Goblin Prime: $10 AUD/month (or annual equivalent) - Includes 3 venues, up to 3 hero deals per venue, unlimited regular deals, and enhanced features.
  • •Goblin Elite: $18 AUD/month (or annual equivalent) - Includes unlimited venues, up to 3 hero deals per venue, unlimited regular deals, WhatsApp booking links, and priority support.

Billing:

  • •Subscriptions are billed through Stripe. By subscribing, you agree to Stripe's terms of service and privacy policy.
  • •Monthly subscriptions are billed monthly on the same day of the month as your initial subscription. Annual subscriptions are billed once per year.
  • •You can manage your subscription, update payment methods, and cancel your subscription at any time through the Stripe Customer Portal accessible from your account settings.
  • •Refunds are handled in accordance with our refund policy and applicable consumer protection laws. Contact us for refund requests.
  • •If payment fails or your subscription expires, your account will be downgraded to the Free plan, and you may lose access to premium features.
  • •We reserve the right to change subscription prices with 30 days' notice. Price changes will apply to your next billing cycle.

Platform Is Not a Party to Transactions

Deal Goblins is a platform that facilitates the discovery of deals between diners and venues. We are not a party to any transaction, agreement, or contract between diners and venues.

All transactions, including the purchase of food, beverages, or services, are solely between the diner and the venue. Deal Goblins does not:

  • •Act as an agent, representative, or intermediary in any transaction
  • •Guarantee the availability, quality, or fulfillment of any deal
  • •Process payments or handle refunds for transactions between diners and venues
  • •Assume any liability for disputes, issues, or problems arising from transactions between diners and venues

By using Deal Goblins, you acknowledge and agree that Deal Goblins is not responsible for any loss, damage, or inconvenience arising from your interactions with venues or your use of deals published on the platform. Any claims, disputes, or issues must be resolved directly between you and the venue.

Prohibited Conduct

Users must not:

  • •Use the platform for fraudulent or illegal activities.
  • •Post or distribute harmful, misleading, offensive, or deceptive content, including fake deals or inaccurate pricing information.
  • •Attempt to interfere with the security or functionality of the platform, including hacking, scraping, or introducing malware.
  • •Impersonate other users, venues, or entities, or misrepresent your identity or affiliation.
  • •Violate any applicable laws, regulations, or third-party rights, including intellectual property rights.
  • •Use automated systems or bots to access or interact with the platform without our express written permission.
  • •Collect or harvest user data, contact information, or other personal information from the platform.
  • •Engage in any activity that could damage, disable, or impair the platform or interfere with other users' access to the platform.
  • •Scraping and Data Extraction: You may not scrape, copy, harvest, or use automated tools, scripts, bots, or any other means to extract, collect, or reproduce deal data, venue information, or any other content from the platform. This includes, but is not limited to, using our data for AI model training, competitive analysis, or any commercial purpose without our express written permission. Violation of this provision may result in immediate termination of your access and legal action.

Intellectual Property

All content on Deal Goblins, including logos, text, graphics, software, and the overall design, is our property or licensed to us. You may not reproduce, modify, distribute, or create derivative works from our content without written permission.

User Content: By submitting content to Deal Goblins (including venue information, deal listings, images, and descriptions), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content on the platform and in our marketing materials.

You retain ownership of your content and are responsible for ensuring you have the right to grant us this license. You represent and warrant that your content does not infringe on any third-party rights, including intellectual property, privacy, or publicity rights.

If you believe your intellectual property rights have been violated on our platform, please contact us with details of the alleged infringement.

Disclaimers & Limitation of Liability

Platform Availability: Deal Goblins is provided "as is" and "as available." We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses or other harmful components.

Deal Information: While we strive to ensure accuracy, we do not guarantee the accuracy, completeness, or timeliness of deal information on the platform. Deal availability, pricing, and terms are subject to change by venues without notice. We are not responsible for venues' failure to honor published deals.

Third-Party Services: Deal Goblins may integrate with third-party services (such as Google authentication, Stripe, and mapping services). We are not responsible for the availability, accuracy, or practices of these third-party services.

Limitation of Liability: To the maximum extent permitted by law, Deal Goblins and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.

Australian Consumer Law: Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other applicable consumer protection legislation that cannot be excluded, restricted, or modified.

Right to Remove Accounts & Content

Deal Goblins reserves the absolute right, in our sole discretion and without prior notice, to:

  • •Remove deals: Remove, reject, edit, or hide any deal listing that we determine violates these terms, is inaccurate, misleading, or does not meet our quality standards.
  • •Remove venues: Remove, suspend, or reject any venue listing, including duplicate venues, venues with unverified information, or venues that fail to meet our verification requirements.
  • •Limit or suspend features: Restrict, limit, or suspend access to platform features, including the ability to create deals, edit venues, or access premium features, for any reason we deem necessary.
  • •Reject duplicate venues: Prevent the creation of duplicate venue listings or merge existing duplicates to maintain platform quality and prevent confusion.
  • •Prevent misleading usage: Take action against accounts, venues, or deals that we determine are misleading, fraudulent, or intended to deceive users.
  • •Suspend or terminate accounts: Suspend or terminate user accounts, venue listings, or access to the platform immediately and without notice if we determine, in our sole discretion, that you have violated these terms or engaged in conduct that we deem harmful to the platform or its users.

We are under no obligation to provide notice or explanation for content removal or account actions, though we may do so at our discretion. Our decisions regarding content removal and account management are final.

Termination

By You: You may terminate your account at any time by canceling your subscription (if applicable) and contacting us to request account deletion. Upon termination, your access to the platform will cease, and your content may be removed.

By Us: We reserve the right to suspend or terminate your account immediately, without notice, if you:

  • •Violate these Terms of Use
  • •Engage in fraudulent or illegal activities
  • •Fail to pay subscription fees when due
  • •Misuse the platform or interfere with other users' access
  • •Provide false, inaccurate, or misleading information

Upon termination, all licenses granted to you will immediately cease, and you must stop using the platform. We may delete your account and content, though we reserve the right to retain certain information as required by law or for legitimate business purposes.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Australia. Any disputes arising from or relating to these terms or your use of the platform will be subject to the exclusive jurisdiction of the courts of Australia.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will notify users of material changes by posting the updated terms on this page and updating the "Last Updated" date. Your continued use of the platform after such changes constitutes acceptance of the modified terms.

If you do not agree to the modified terms, you must stop using the platform and may terminate your account as described in the Termination section.
